Farmers and Merchants Bank reserves the right to determine eligibility for any Product. You acknowledge and agree that any communications and/or information which you provide to us via the Site or via other electronic means is on a non-confidential basis and may be used and/or reproduced by Farmers and Merchants Bank for any purpose, subject to Farmers and Merchants Bank's privacy statement and policies. The terms and conditions of Farmers and Merchants Bank's Online Banking Agreement are incorporated herein by reference, and the Terms of Use set forth herein shall be deemed incorporated in Farmers and Merchants Bank's Online Banking Agreement.

Any and all pages, screens, text, content and images are owned by Farmers and Merchants Bank and/or others as may be indicated, and may not be downloaded, copied, displayed, distributed, licensed, modified, published, reposted, reused, resold, reproduced, transmitted, used for a derivative use, or otherwise used without the express prior written consent of Farmers and Merchants Bank.

You acknowledge and agree that there may be delays, omissions, errors or inaccuracies with respect to the Site and the Products, and that this Site may be inaccessible or closed at any time without notice. You agree that Farmers and Merchants Bank may deny or terminate access to the Site and any Product, or any portion thereof, at its sole discretion, without notice and without limitation. In the event of such limitation or termination, you agree that Farmers and Merchants Bank shall have no liability with respect thereto.

You agree to indemnify Farmers and Merchants Bank from and against any and all direct and indirect liability, loss, cost and expense, including reasonable attorney fees, arising as a result of illegal or unlawful use of this Site by you, your failure to comply with these Terms of Use, and/or your failure to comply with your responsibilities herein. Your obligations hereunder will survive any termination of your use of the Site, these Terms of Use, and your use of any Products. You acknowledge and agree that use of the Site shall be subject to Arkansas law as well as applicable federal law, and that venue for any matters arising under these terms of use shall be located at Stuttgart, Arkansas.
